Property Division in Illinois

Contrary to popular belief, Illinois family laws do not require an even 50/50 split of marital property. Rather, Illinois law states that marital property shall be divided in a manner which is “just and equitable.” Although case law gives some direction to judges as to what constitutes a “just and equitable” division of assets, the final determination of property division in any case is a complex and often gray matter which is subject to the quality of arguments presented by attorneys and the subjective views of a given judge.

Property division requires the court to first determine which assets and debts make up the marital estate and which are non-marital assets and debts. The marital estate includes those assets that are considered to be the joint property of both spouses. Non-marital assets are those assets that are owned by a spouse prior to a marriage or are obtained as a gift, inheritance, or pursuant to a prenuptial/postnuptial agreement. A number of factors determine whether assets and debts are part of the marital estate, such as when the property was acquired, how the title is held, and whether there has been a change or co-mingling of the assets with marital property.
